I hate to break it to you [Developer for Awakened Studio] But we would not be sued for infringement, Our project is still going strong! All of these concepts and content was created by the developers at Awakened Studio. We are making our own individual project, It is not a Copy of SAO, like what you may see in mainstream media. We are making a standalone title with influences from Sword Art Online. As of right now, we are simply codenaming our project "SAO". That is not the official name of our title ;)
