The original author of Dune was Frank Herbert, it was a Novel, and it was written in 1965...
Now if EA has bought the rights to Dune, they could stop it. Have they? I have no idea. xD
Yeah I know it's a novel =) Usually something this big has copyrights from somewhere, I'm not certain but it would be in your best interest to investigate that thoroughly. Would be a shame to get shut down half way through production =/
